    A proposal to update the Uniform Bail and Penalty Schedule has been published for comment at http://www.courts.ca.gov/policyadmin-invitationstocomment.htm.

    The Traffic Advisory Committee proposes revisions to the Uniform Bail and Penalty Schedules: 2016 Edition, to become effective January 1, 2016. The proposed revisions bring the schedules into conformance with recent legislation as required under Vehicle Code section 40310 and Penal Code section 1269b.
    The deadline for comment is Tuesday, November 3, 2015.

    Applications for membership on the Capital Habeas Attorney Panel for the Central District of California are now being accepted.
    ABOUT THE PANEL
    Habeas corpus petitions involving the death penalty that are not assigned to the Office of the Federal Public Defender will be assigned to attorneys on the Capital Habeas Attorney Panel. Attorneys who apply for panel membership agree to accept the assignment of at least one capital habeas case.
    QUALIFICATIONS
    Applicants will be screened to ensure they possess the background, knowledge, and experience required by 18 U.S.C. § 3599, and necessary to represent a petitioner properly, with due consideration to the seriousness of the penalty and to the unique and complex nature of the litigation. State or federal habeas experience is highly desirable.
    APPLICATION PROCESS
    Interested attorneys must submit a completed application, writing samples, and references. The application form and instructions are available on the Court’s web site at www.cacd.uscourts.gov/attorneys/capital-habeas/forms-and-worksheets. Completed applications must be submitted by November 30, 2015.

    POSITION OVERVIEW
    The United States District Court for the Central District of California invites applications for one full-time Pro Se Staff Attorney vacancy. A Pro Se Staff Attorney works under the supervision of United States Magistrate Judges. Duties of the position include drafting legal memoranda, Reports and Recommendations, Decisions and Orders, as well as analyzing statutes and legal issues in state and federal habeas corpus, civil rights and social security disability matters. A Pro Se Attorney may work on cases assigned to all Divisions of the Court. Additional pro se staff attorneys may be hired from this recruitment notice.

    MINIMUM QUALIFICATIONS
    Strong academic credentials from an ABA-accredited law school, polished writing skills, and superior analytical ability is required. Legal experience in one or more of the following areas will be favorably considered: civil rights; habeas corpus; social security disability; and criminal appellate law. Bar membership is also required. Litigation experience preferred. Applicants must be computer literate.
    The successful candidate must be a U.S. citizen or a lawful permanent resident of the United States currently seeking citizenship or intending to become a citizen after meeting the eligibility requirements.

    COMPENSATION AND BENEFITS
    Compensation will be set based on the experience and qualifications of the successful candidate subject to the policies and guidelines set forth in the Judicial Salary Plan. Career Law Clerks qualify for federal employees’ group health insurance, retirement benefits, flexible spending accounts, vision, dental and life insurance. Federal employees observe ten paid holidays per year.

    Attached please find an Invitation to Comment regarding the proposed rule revisions. This proposal is being distributed for public comment in compliance with California Rules of Court, rule 10.613(g). The proposed revisions may be found on the Court’s website at www.occourts.org.     The Criminal Law and Traffic Advisory Committees propose amending rule 4.105 of the California Rules of Court to apply the rule to non-traffic infractions and require courts to consider the totality of the circumstances of a particular case when making bail determinations before trial. The committees also propose adding an advisory committee comment to clarify the scope of the rule and explain that consideration of the totality of the circumstances includes whether an order setting bail would impose an undue hardship on the defendant. The proposed amendments were developed in response to recent Judicial Council directives to expand the application of the rule and promote access to justice in all infraction cases.
