    Purpose:

    • Responsible for heading the Privacy Office and serving as primary counsel to the Company and relevant business units to mitigate risk related to privacy issues.
    • Oversees all ongoing activities related to the development, implementation, maintenance of, and adherence to the company's policies and procedures regarding the privacy of, and access to, company-related information. This includes compliance with data privacy regulations in connection with information concerning clients, customers, HAEA and other IT partners, employees, business practices and operations, and enterprise IT systems.

    Major Responsibilities:

    • Responsible for the development, implementation, maintenance, and adherence to the company's privacy strategy and program. Ensure that privacy practices are in place and compliant with applicable laws and industry-specific regulations.
    • Collaborate with key stakeholders (e.g., IT leaders, Office of Customer Management, Human Resources, and Legal) and committees to ensure that the company has and maintains appropriate privacy requirements and applicable information notices and materials reflecting current legal practices and organization requirements.
    • Performs initial and periodic information privacy risk assessments and conducts related ongoing compliance monitoring activities in coordination with the company's other compliance and operation assessment functions.
    • Initiates, facilitates and promotes activities to foster information privacy awareness within the organization and related entities.
    • Reviews all system-related information security plans throughout the company to ensure alignment between security and privacy practices.
    • Works with all company personnel involved with any aspect of release of protected company information to ensure full coordination and cooperation under the policies and legal requirements.
    • Serves as information privacy counsel to the Company for all departments and appropriate entities.
    • Maintain knowledge of privacy practices across the company in order to better understand and isolate the risk of exposure or liabilities, recommend realistic preventive measures, and respond to information security incidents.
    • Support controls and compliance requirements specified by internal and/or external audit.
    • Maintain current knowledge of applicable federal and state privacy legislation and regulations and monitors industry trends and advancements to ensure company adaptation and compliance.
    • Monitor HMA's data usage including vehicle technologies, data usage rights, data ownership with partners, vendors and affiliates, online behavioral advertising, mobile device usage, social media, etc.
    • Collaborate with HAEA as well as relevant vendors and business units to manage data breach incidents, any required breach notifications and any required remediation.
    • Serve as liaison to respond to inquiries from outside parties (e.g., government, NGO's, etc.).
    • Obtain relevant Company privacy certifications and manage any applicable registrations with state and federal authorities.
    • Assist with the retention and coordination of outside counsel, communications counsel, forensics firms, credit monitoring services, experts and investigators and other vendors, as needed.
    • Prepare written reports for review by senior management regarding trends.
    • Manage staff, effectively coach, counsel, and develop staff. Utilize the diverse talents of the staff by efficiently managing staff's time, materials and budget while focusing on the goals and vision of the company.

    Authority:

    • Establish and administer policies and practices as they relate to privacy protection of company information.
    • Authority to direct activities of assigned staff.

    Education:

    • Bachelor's degree required.
    • Master's degree a plus
    • Juris Doctorate required; from a top tier law school a plus.

    Related Experience:

    • Ten plus years of broad privacy and data protection, compliance or legal experience.
    • Three to five years of supervisory experience desired.

    Skill / Knowledge:

    • Strong technology acumen and the ability to assess privacy gaps.
    • Understanding of information security governance frameworks and related controls.
    • Strong project management skills as well as process development background.
    • Ability to analyze and interpret complex data protection and privacy laws and regulations.
    • Excellent written and verbal communication skills.
    • Ability to interact effectively with all levels of personnel, outside counsel and vendors.
    • Ability to operate and employ solid decision-making skills.
    • Ability to develop and maintain highly effective relationships externally and internally.
    • Ability to influence professionals of senior management level.
    • Strong analytical skills particularly in regard to assessing the probability and impact of an internal control weakness.
    • Proficiency in various computer programs, including Word, Excel, PowerPoint.

    Certification Required:

    • Certified Information Privacy Professional/United States (CIPP/US) designation from the International Association of Privacy Professionals is required.
    • Member of California State Bar Association.

    The Advisory Committee on Civil Jury Instructions has approved and posted its 27th release of proposed revisions to the civil instructions (CACI) for public comment. In response to developments in the law over the last six months, this release includes proposed new and revised instructions and verdict forms, and one proposed renumbered verdict form (CACI No. VF-405). We are very interested in your input.
     
    The proposed changes and additions are available for viewing on the internet at http://www.courts.ca.gov/policyadmin-invitationstocomment.htm
    Only these currently proposed changes and additions are being submitted for comment at this time. We will gladly accept other comments, but the committee will not be able to consider them until the next release cycle.
     
    Our preferred way of receiving your comments is in a Word file attached to an e-mail sent to civiljuryinstructions@jud.ca.gov. However, you may also respond online.  And we have also posted a comment form that you may use to comment on individual instruction or groups of instructions.     Purpose:
    ~ Responsible for legal representation and advice to HMA departments and executives in the primary areas of contractual matters, BlueLink/Connected Car, Office of Customer Management, data sharing, privacy, antitrust, compliance, policy development and risk management, plus ancillary training of employees related to the foregoing areas.

    Major Responsibilities:
    ~ Internal legal work pertaining to all HMA contracting terms, privacy and data sharing policies, supplier and employee compliance issues, antitrust inquiries and new product development.
    ~ Review and negotiate documentation, draft such documents as the particular deal may require, including corporate resolutions, legal opinions, and all required agreements.
    ~ Advise and review procedures for compliance with governing law, including but not limited to, state and federal privacy laws, licensing requirements, antitrust matters, DMV compliance, and applicable disclosure and reporting requirements. Maintain current knowledge of recent developments in case law and changes to statutes and regulations.
    ~ Negotiate, draft, and/or review of HMA supplier and inter-company contracts with a value or potential liability of $100,000 or higher. Train, advise and assist the Purchasing Department staff with review and negotiation of HMA contracts with a value or potential liability under $100,000.
    ~ Assist the Associate General Counsel, Risk Management with risk management issues, special projects and task force assignments, as needed.
    ~ Provide legal advice concerning insurance and risk management matters affecting HMA privacy and network security.
    ~ Provide legal advice and oversight in litigation matters related to assigned HMA clients.
    ~ As needed, draft corporate minutes, respond to state and federal government inquiries, and assist with policy development matters.
    ~ Continual training and education of employees and management in changing areas of legal requirements.

    Authority:
    ~ Authority to negotiate all contractual language for the company.

    • Manage all administrative tasks for the Division.
    • Coordinate the daily affairs for the Division Head to meet the diverse requirements of HMC, HMA Regions, and direct reports under Division Head’s supervision.

    • Generate monthly Warranty Reimbursement reports.
    • Create monthly accrual list for Finance Department, indicate pending invoice settlements and (SAP inquiry) and invoices not posted at month end.
    • Assist with casting, finalizing and monitoring of the Legal Department budgets. Utilize SAP software to create check request/purchase requests.
    • Work with the Division Head’s direct reports to ensure goal setting and year-end evaluations are completed in a timely manner.
    • Maintain and update Outlook contact and/or email groups.
    • Review files/materials for accuracy and consistency.
    • Prepare and/or assist in preparation of reports and presentations as required by management.
    • Coordinate and schedule meetings internally and/or with clients and vendors.
    • Provide assistance in researching and analyzing division related information, if, and when, necessary.
    • Maintain and update division specific system/software.
    • Provide administrative support for division managers and employees, if, and when, necessary.
    • Manage internal/external correspondence, handling highly confidential issues.
    • Provide office administration including, but not limited to, SAP, Casetrack software, financial program, filing, meeting arrangements, report preparation and editing, HMA record management, ad hoc reports, and telephone screening.
    • Any other tasks and responsibilities, not limited to above, as assigned by the Division Head. 

    Authority:

    This position stands alone as the Executive Assistant wears many different hats and has to organize and coordinate all aspects of the work environment. Though decisions are not critical to the running of the division or company, each decision is based on knowledge and understanding of what needs to be done to bring a project to closure in a professional, collaborative and timely manner.

    Education:

    • ~ Must be a high school graduate.
    • ~ Bachelor’s degree preferred.

    Related Experience:

    Two to four years of administrative work experience in a professional office environment, preferably two plus years working at higher management level.

    Skill / Knowledge:

    • ~ Proficient in the use of Microsoft Word/Excel, Outlook, and PowerPoint.

    SP15-03: Judicial Administration: Rule for Advisory Committee on Financial Accountability and Efficiency for the Judicial Branch
    The Executive and Planning Committee (E&P) recommends that rule 10.63 of the California Rules of Court, which concerns the Advisory Committee on Financial Accountability and Efficiency for the Judicial Branch, be amended to expand the committee’s charge by modifying the description of its duties, to provide more specificity to the membership criteria, to add a membership category, and to make technical changes.
    The deadline for comment is Friday, June 5, 2015.
     
    SP15-04: Judicial Administration: Implementation of Court Technology Governance and Strategic Plan
    This proposal would amend rules 10.16 and 10.53 of the California Rules of Court to implement the Court Technology Governance and Strategic Plan, recommended by the Technology Planning Task Force and adopted by the Judicial Council. Among the task force’s recommendations was revising the roles and responsibilities of the Judicial Council Technology Committee (JCTC) and the Court Technology Advisory Committee (CTAC). The task force also recommended changing CTAC’s name to the Information Technology Advisory Committee to reflect its broader role and responsibilities as sponsor of branchwide technology initiatives.
